Intermediary liability regimes and immunity provisions: a comparative analysis between the Marco Civil da Internet and NetzDG

Abstract

The project compares the contexts in which Germany and Brazil developed their own regulations and intermediary liability systems dedicated to social media platforms. It also investigates their role of such regulations in the digital environment, their application and effectiveness for relevant online speech events since their promulgation and also the role of events, actors and interests that have pushed the policy-making process in this area.

Lastly, this project will analyse how up-and-coming legislations/draft bills such as the Digital Services Act and the Brazilian Disinformation Draft Bill will join the dialogue about platform governance and enhance the liability regimes introduced in both countries by NetzDG and the Brazilian Civil Rights Framework for the Internet.
