It has become commonplace to lament about the state of the European Union, decrying its financial woes, economic sluggishness, technocratic heavy-handedness, neo-liberal flattening of citizenship and general democratic deficit. But can the European constitutional order also  be understood as reflecting a genuinely innovative conception of law and politics? And, if so, can it be understood as a model that, notwithstanding its imperfections, provides an example to the world as to what constitutionalism should become? If so, what exactly is innovative and normatively attractive about it and to what extent is it universalizable?
